Mobile Future Comments on Privacy

The issue of privacy is a consumer priority and an industry imperative. Unfortunately, the debate over the Federal Communication Commission’s (FCC) Broadband Privacy Order has placed the issue at a crossroads. Fortunately, the Federal Trade Commission’s (FTC) well-tested approach to privacy – which we reiterate in comments filed at the FCC this week – offers a clear path forward. The current FCC’s Order, in fact, harms those it seeks to protect, applying different rules to a subset of the complex Internet ecosystem, while other participants remain subject to the FTC’s regulations, creating consumer confusion. The Order also adopts an overbroad definition of “sensitive” information, upending the current opt-out model without consideration for economic costs and benefits of different models to consumers. At the end of the day, the current Order does not serve the best interests of wireless consumers, and we urge the FCC to follow decades of FTC precedent by returning to a consistent set of privacy protections that are pro-consumer and pro-innovation.
